Article 1 - Definitions
In these terms and conditions:

1. Day: calendar day;

2. Identity of the entrepreneur;

3. Durable data carrier: any means that enables the consumer or entrepreneur to store information that is addressed to him personally in a way that allows future consultation and unaltered reproduction of the stored information;

4. Distant Agreement: an agreement by means of an Name Your Porsche organized system for distant sales of products, up to and including the closing of the agreement, by which exclusive use is made  of one or more techniques for distant communication;

5. Technique for distance communication: means which can be used to close an agreement, without  consumer and entrepreneur meeting simultaneously in the same room;

6. General Terms and Conditions: the present General Terms and Conditions of Name Your Porsche.

Article 2 - Identity of the entrepreneur

Article 3 - Applicability

1. These general terms and conditions apply to every offer from Name Your Porsche and to every distant contract concluded and orders between Name Your Porsche and the customer.

2. As part of the agreement, the customer must have accepted the general terms and conditions and indicate this by agreeing them on our website.

3. Name Your Porsche may modify or annul any term or condition for any reason, at any time, by posting a new version on our website. These changes do not affect rights that arose prior to such changes. 4. Situations that are not regulated in these general terms and conditions must be assessed 'in the spirit' of these general terms and conditions.

4. Uncertainties about the explanation or content of one or more provisions of our terms and conditions must be explained 'in the spirit' of these general terms and conditions.

Article 4 - The Name Your Porsche product

1. The offer contains a complete and accurate description of the product offered. The description is sufficiently detailed to allow a proper assessment of the offer by the customer. The images used are a true representation of the product. Obvious mistakes or errors in the offer do not bind Name Your Porsche.

2. All images and specifications in the offer are indicative and cannot give right to compensation or dissolution of the agreement.

3. Images are a true representation of the product offered. Name Your Porsche cannot guarantee that the displayed colours exactly match the real colours of the products.

4. With the shipment and payment of the order, the price, including taxes; payable by the customer; the cost of shipping; and these terms and conditions are clear and accepted.

Article 5 - The agreement

1. The agreement is concluded when the customer has fulfilled his payment obligation.

2. Name Your Porsche sends an e-mail to confirm that the order has been processed.

3. The agreement cannot be withdrawn, cancelled or changed in any way. This is due to the personalized nature of the product. Each order is designed and produced exclusively and forms a unique product for an individual customer.

4. Name Your Porsche takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a secure web environment. This also applies to payments. Excluded are problems that arise on the side of the partnering parties, such as, but not limited to credit card companies, banks and shipping companies.

5. Name Your Porsche can - within legal boundaries - determine whether the customer can meet payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the distant contract. If based on this investigation, Name Your Porsche has grounds not to proceed with an agreement, Name Your Porsche will be entitled to refuse an order or request or to attach special conditions to the implementation.

6. Every agreement is entered into under the conditions precedent of sufficient availability of resources and products.

7. All prices are subject to printing and typing errors. No liability is accepted for the consequences of printing and typing-errors. In the event of printing and typing-errors, Name Your Porsche is not obliged to deliver the product at the incorrect price.

Article 6 - Conformity and warranty

1. Name Your Porsche guarantees that its products comply with the agreement, the specifications stated in the offer, and the reasonable requirements of soundness and/or usability.

2. Any defects or incorrectly delivered products must be reported to Name Your Porsche in writing within 1 month after delivery. Any return of the products must be in the original packaging and in new condition.

3. The guarantee does not apply if: the customer has repaired and/or modified the delivered products himself or had them repaired and/or modified by third parties; the delivered products have been exposed to abnormal conditions or are otherwise carelessly treated or are contrary to the instructions of Name Your Porsche; the defect is wholly or partly the result of regulations that the government has set or will set with regards to the nature or quality of the materials used.

Article 7 - Delivery and performance

1. Name Your Porsche will take the greatest possible care when receiving and executing orders for its products.

2. The place of delivery is the address that the customer has made known to Name Your Porsche.

3. With due observance of what is stated in paragraph 4 of this article, Name Your Porsche will execute accepted orders expeditiously but at the latest within 30 days, unless the customer has agreed to a longer delivery period. If the delivery is delayed, or if an order cannot or only partially be executed, the consumer will be notified of this no later than 30 days after he has placed the order. The consumer is not entitled to compensation.

4. All delivery times are indicative. The customer cannot derive any rights from any stated terms. Exceeding a term does not entitle the customer to compensation.

5. The risk of damage and/or loss of products rests with Name Your Porsche until the moment of delivery to the customer or a pre-designated representative made known to Name Your Porsche unless expressly agreed otherwise. Name Your Porsche bears no responsibility whatsoever in the event that a in case something happens to the shipment after it has been received by the client.

Article 8 - Complaints procedure

1. Complaints regarding the performance of the product must be submitted fully and clearly described, to Name Your Porsche within 1 month.

2. Complaints submitted to Name Your Porsche will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, Name Your Porsche will respond within the period of 14 days with a notice of receipt and an indication of when the consumer can expect a more detailed answer.

3. If a complaint is found to be justified by Name Your Porsche, it will, at its own discretion, replace or repair the delivered product free of charge.

Article 9 - Disputes

1. Only Dutch law applies to agreements between the entrepreneur and the consumer to which these general terms and conditions apply. Even if the consumer lives abroad.

2. The CISG (Contracts for the International Sales of Goods) does not apply.
